Terms of Service
These Terms of Service ("Terms") govern your access to and use of GitOpen.dev and our websites, features, and related services (collectively, the "Service"), operated by us ("we", "us", or "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service
GitOpen.dev provides a community-oriented directory to discover, browse, and share open-source repositories and related information. We may add, change, or discontinue features at any time. The Service depends on third-party platforms (such as GitHub) and infrastructure providers; we do not control those services and are not responsible for their availability or content.
2. Eligibility
You must be able to form a binding contract in your jurisdiction and meet any minimum age we require (generally at least the age of majority or 16, whichever is higher under applicable law). If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. Accounts and authentication
Some features require an account. You may sign in using third-party authentication (for example GitHub). You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us promptly if you suspect unauthorized use. We may suspend or terminate accounts that violate these Terms or pose risk to the Service or other users.
4. Your content and submissions
You may submit or post content such as repository metadata, descriptions, links, profile information, or other materials ("User Content"). You retain ownership of your User Content. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, distribute, and otherwise use User Content as reasonably necessary to operate, promote, and improve the Service.
You represent and warrant that:
- You have all rights and permissions needed to submit the User Content;
- Your User Content does not infringe any third party's rights or violate applicable law;
- For repository listings, you have authority to share the information you provide or it is already public under the project's normal distribution.
We may remove or refuse User Content that we reasonably believe violates these Terms, the law, or the rights of others, or that harms the Service or users.
5. Acceptable use
You agree not to:
- Use the Service for unlawful, fraudulent, or harmful purposes;
- Harass, abuse, threaten, or discriminate against others, or publish illegal, defamatory, or obscene material;
- Attempt to gain unauthorized access to systems, accounts, or data; interfere with or disrupt the Service; or deploy malware or excessive automated access without permission;
- Misrepresent your identity, scrape the Service in violation of our technical limits, or resell access to the Service without our written consent;
- Use the Service to distribute spam, malware, or content that violates others' intellectual property or privacy rights.
6. Third-party services and open-source software
The Service may link to or integrate with third-party websites, APIs, and authentication providers (including GitHub). Your use of those services is subject to their terms and policies. Open-source projects listed on the Service are governed by their own licenses; we do not grant you any license to third-party code beyond what those projects provide.
7. Intellectual property
Except for User Content and third-party materials, the Service itself—including branding, design, and original text we provide—is owned by us or our licensors and is protected by intellectual property laws. You may not copy, modify, or create derivative works of the Service except as allowed by law or with our prior written permission.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. DIRECTORY LISTINGS AND USER CONTENT ARE PROVIDED BY USERS AND THIRD PARTIES; WE DO NOT ENDORSE OR GUARANTEE THE ACCURACY, SAFETY, OR LEGALITY OF ANY LISTING OR PROJECT.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE OR OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM (IF ANY) OR (B) ONE HUNDRED U.S. DOLLARS (USD $100), EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.
10. Indemnity
You will defend, indemnify, and hold harmless us and our affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your User Content, your use of the Service, or your violation of these Terms or applicable law.
11. Termination
You may stop using the Service at any time. We may suspend or terminate your access to the Service with or without notice if we believe you have breached these Terms, if required by law, or to protect the Service or others. Provisions that by their nature should survive (including licenses granted to us for User Content as needed to operate archival copies, disclaimers, limitations of liability, indemnity, and governing law) will survive termination.
12. Changes to these Terms
We may modify these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. If changes are material, we may provide additional notice (for example via the Service or email where appropriate). Your continued use after the effective date constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Service.
13. Governing law and disputes
These Terms are governed by the laws applicable in the jurisdiction where the operator of the Service is established, without regard to conflict-of-law rules, except where mandatory consumer protections in your country require otherwise. Courts in that jurisdiction (or another forum we specify in writing) have exclusive jurisdiction over disputes, unless applicable law gives you a non-waivable right to bring claims in your home courts.
14. General
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service. If any provision is held invalid, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
